Estado e sociedade civil num contexto democrático: arenas de conflitos e de constituição de direitos

Resumo
O presente texto objetiva definir os conceitos de Estado moderno e sociedade civil a partir da ótica do conflito fundamentada pelo modelo teórico relacional. De acordo com essa perspectiva, entende-se que o Estado moderno e a sociedade civil são arenas de lutas nas quais os direitos são constituídos e afirmados pelas classes e grupos sociais. Assim, este artigo entende que embora ambos os espaços sejam arenas de conflitos, estes se tornam internalizados e racionalizados por essas instituições, sobretudo pelos seus canais de representação, em particular os de caráter funcional. Portanto, encontra-se no sistema democrático um contexto que possibilita, através de suas instituições de representação societal e estatal, os espaços para a resolução pacífica dos conflitos abertos entre classes e grupos sociais e a afirmação dos direitos.

Abstract
This text aims at defining the concepts of the modern State and the civil society through the optics of the conflict motivated by the theoretical relational model. According to this perspective, it is understood that the modern State and the civil society are arenas of fights in which the rights are constituted and asserted by the classes and the civil society. Thus, this article portrays the idea that although both spaces are arenas of conflicts, they become internalized and rationalized by these institutions, mostly by their channels of representation, particularly the ones of functional character. Therefore, it is found in the democratic system a context that enables the spaces for a peaceful solution for the conflicts between the classes and the social groups and the affirmation of their rights through the institutions of social  and state representation.
